How did you calculate the amount you are owed?

You want to be as clear as possible when explaining how you calculated the amount you are owed by the defendant (the person you intend to sue). 

Why?

  • You want the judge to be able to understand why you are requesting a specific amount. 
  • If a judge does not understand, they will have the defendant pay you what the judge thinks the defendant owes you.

How much should I write?

  • It is suggested you write at least 1 sentence. 
  • While there is no minimum, there is a maximum of 1 page.

If you are owed money for 1 reason:

State exactly how you came to that amount owed.

Examples:

  • Security Deposit.
    • I am owed $_____, because that is the amount of my security deposit that the defendant did not return to me.
    • I am owed $____, because that is the amount of damages to my unit that the security deposit did not cover. 
  • Rent
    • I am owed $____, because that is the amount of 1 month of rent.
  • Loans
    • I am owed $____, because that is the amount I loaned the defendant.
  • Repair work
    • I am owed $____, because that is the amount I would have to spend to hire someone else to fix the work the defendant did.
    • I am owed $____, because that is the amount of my hourly/contract price to do the repair work I did for the defendant.
  • Contract for a Service
    • I am owed $____, because that is the amount of the contract I had with the defendant.

If you are owed money for more than 1 reason:

  • We have found that the best way to organize your case is to divide the calculations into different issues. 
  • For example, if the Defendant owes you money because their security deposit did not cover repairs and they did not pay you rent, then you would write the following:
    • (1) Security Deposit did not cover damage to the unit:
      • I am owed $2000 (total damage to unit) - $1000 (amount of security deposit)= $1,000 what I am owed. 
    • (2) Rent was not paid for August and September:
      • Per the contract, monthly rent was $2,000.
      • I was not paid for 2 months of rent.
      • 2 months x $2,000 (monthly rent) = $4,000 what I am owed.
